1. Acceptance of Terms

By accessing or using ChatCade, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service. ChatCade is intended for users who are 18 years of age or older.

2. Description of Service

ChatCade is a real-time social networking application that enables users to communicate through text messages, photos, and voice memos in chatrooms and private conversations. The service also includes integrated turn-based games that users can play with other members. Premium features include exclusive chatrooms, advanced customization options, and enhanced gaming experiences.

3. Age Requirement

ChatCade is intended for users who are 18 years of age or older. By using this service, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use ChatCade. We reserve the right to request proof of age at any time and to terminate accounts of users who do not meet the age requirement.

4. User Accounts and Registration

To use ChatCade, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You may not share your account with others or create multiple accounts to circumvent service limitations.

5. User Conduct and Prohibited Activities

You agree not to use ChatCade to: (a) violate any laws or regulations; (b) harass, abuse, threaten, or harm other users; (c) post or transmit content that is illegal, obscene, defamatory, or violates others' rights; (d) impersonate others or provide false information; (e) spam, send unsolicited messages, or engage in commercial activities without permission; (f) interfere with or disrupt the service or servers; (g) attempt to gain unauthorized access to any part of the service; (h) use automated systems to access the service; (i) collect or harvest user information without consent; (j) post content containing viruses or malicious code.

6. User-Generated Content

You retain ownership of content you create and share on ChatCade. However, by posting content, you grant ChatCade a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of operating and providing the service. You represent that you have the right to grant this license and that your content does not violate any third-party rights. ChatCade reserves the right to remove, edit, or refuse to post any content that violates these terms.

7. Content Moderation and Reporting

ChatCade employs automated and manual content moderation to maintain a safe environment. Users can report inappropriate content or behavior through in-app reporting features. Reported content will be reviewed, and appropriate action will be taken, which may include content removal, account warnings, temporary suspension, or permanent account termination. Decisions regarding content moderation are at ChatCade's sole discretion.

8. Intellectual Property Rights

All content, features, and functionality of ChatCade, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of ChatCade or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the service without prior written permission.

9. In-App Purchases and Subscriptions

ChatCade offers premium subscriptions and in-app purchases for virtual currency (coins) that can be used to purchase badges, avatar frames, and other cosmetic items. All purchases are final and non-refundable unless required by law. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions through your Apple ID account settings. Prices may vary by location and are subject to change.

10. Account Termination and Suspension

ChatCade reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or extended periods of inactivity. Upon termination, your right to use the service will immediately cease. You may also delete your account at any time through the app settings. Account deletion is permanent and cannot be undone.

11. Privacy and Data Collection

Your use of ChatCade is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the service, you consent to the collection and use of information as described in the Privacy Policy. Please review the Privacy Policy carefully.

12. Disclaimers and Limitation of Liability

ChatCade is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, ChatCade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

13. Indemnification

You agree to indemnify and hold harmless ChatCade, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the service, your violation of these Terms, or your violation of any rights of another.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15. Changes to Terms

ChatCade reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the app and updating the 'Last updated' date. Your continued use of the service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the service and delete your account.
